Terms of Service

Welcome to Neshima. These Terms of Service (“Terms”) govern your use of the Neshima mobile application (“the App”), operated by Guy Asraf (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. What Neshima is — and what it is not
Neshima provides guided breathing exercises, breathwork programs, and related wellness tools.
Neshima is a wellness product, not a medical device or medical service. The App does not provide medical advice, diagnosis, or treatment. Content in the App — including programs described in relation to stress, sleep, focus, anxiety, or post-traumatic stress — supports general wellbeing and is not a substitute for professional medical or mental-health care. Always consult a qualified healthcare provider about any condition, and never delay or stop treatment because of anything in the App.
2. Safety
Breathwork involves voluntary changes to your breathing and can cause dizziness, light-headedness, or fainting. By using the App you agree to:
- Practice only while seated or lying down in a safe place;
- Never practice while driving, operating machinery, standing, or in or near water;
- Stop immediately if you feel unwell, dizzy, or overwhelmed;
- Not use breath-hold exercises if you are pregnant, or have a cardiac, respiratory, blood-pressure, or seizure condition, unless your doctor approves;
- Use the App only in accordance with these safety guidelines.
If you have or suspect a mental-health condition, including PTSD, use the App as a complement to — never a replacement for — care from a qualified professional. If you are in crisis, contact local emergency services immediately.
3. Who may use the App
You must be at least 16 years old to use the App. If you are under 18, you may use the App only with a parent or guardian’s consent.
4. Subscriptions and purchases
- Parts of the App are free; premium content requires a paid subscription or one-time lifetime purchase (“Premium”).
- Prices are shown in the App before purchase. Payment is charged to your app-store account (Google Play or Apple App Store).
- Auto-renewal: subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before renewal. Manage or cancel any time in your app-store account settings.
- Free trials: if a trial is offered, you will be charged when the trial ends unless you cancel before then. One trial per account.
- Refunds are handled by the app store under its policies.
- Referral rewards (e.g. free months) are promotional, have no cash value, and may be modified or withdrawn at any time.
5. Your content and data
Your practice history, preferences, and quiz answers are stored on your device (see the Privacy Policy). You are responsible for keeping your device secure.
6. Acceptable use
You agree not to copy, modify, distribute, sell, reverse-engineer, or create derivative works of the App or its content, and not to use the App for any unlawful purpose.
7. Intellectual property
The App, including its design, text, audio, graphics, and software, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.
8. Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the App will be uninterrupted or error-free, or that results (including wellbeing outcomes) will be achieved.
9. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from failure to follow the safety guidelines in Section 2. Our total liability for any claim relating to the App shall not exceed the amount you paid us in the twelve months before the claim arose.
Nothing in these Terms excludes liability that cannot be excluded by applicable law.
10. Changes
We may update the App and these Terms from time to time. Material changes will be announced in the App; continued use after changes take effect constitutes acceptance.
11. Termination
We may suspend or terminate access for breach of these Terms. You may stop using the App at any time; deleting the App removes locally stored data.
12. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. These Terms are the entire agreement between you and us regarding the App. Our failure to enforce any right is not a waiver of it.
